What this policy covers
This policy explains what M&K Primary Care & Wellness collects through this website, how it is used, and the choices you have.
Your medical record is treated differently, and more protectively. Health information we hold about you as a patient is protected health information under HIPAA and applicable California law, and how we use and disclose it is described in our Notice of Privacy Practices, which you receive when you become a patient. Where the two documents differ about health information, the Notice of Privacy Practices controls.
What we collect
From this website we collect only what you give us and a small amount of technical information.
- Information you type in: your name, phone number, email address, and anything you write in a message or a booking request.
- Technical information: your device and browser type, and general pages viewed, collected by standard site analytics.
- Information you send us on purpose, such as a question about a service.
Please do not send detailed health information through a website form or an ordinary email. There is a secure place to give us your history once you are a patient, and that is the right place for it.
How we use it
We use what you give us to answer you, to schedule and provide your care, to run the practice, and to meet our legal and professional obligations.
- To reply to you and to book, confirm, and remind you about visits.
- To provide and coordinate your care, and to keep an accurate medical record.
- To take payment for services.
- To improve the site and understand which pages are useful.
We do not sell your information. We do not rent or trade it. We do not use your health information for advertising.
Who we share it with
We share the minimum necessary, and only with parties that have a reason to have it.
- Our care team, so that your care can be provided.
- Service providers who work on our behalf, such as our electronic medical record, our booking system, and our payment processor. Where they handle protected health information, they do so under a Business Associate Agreement that binds them to protect it.
- Licensed pharmacies and laboratories, when a prescription or a test is part of your care.
- Other clinicians involved in your care, with your authorisation where one is required.
- Government agencies, courts, or regulators when the law requires it.
Cookies and analytics
This site uses cookies and similar technology to remember your preferences and to measure general traffic. You can refuse or delete cookies in your browser settings. Some parts of the site may not work as well if you do.
We do not use your health information for advertising, and we do not allow advertising technology on the pages where health information is collected.
Texts and email
If you give us your phone number or email address, we may use them to reach you about your care and your appointments. You can opt out of non-clinical messages at any time.
Ordinary text and email are not fully secure. If you ask us to communicate with you that way, you accept that risk, and you can withdraw that request at any time.
How we protect it
We use secure, access controlled systems, limit who can see your information to those who need it, and train our team on privacy. No system is perfectly secure, and we cannot guarantee that a transmission over the internet is private. If a breach affecting your information occurs, we notify you as the law requires.
How long we keep it
Medical records are kept for the period California law and HIPAA require. Information you send through the website that does not become part of a medical record is kept only as long as it is needed for the purpose you sent it for.
Your rights
As a patient you have rights over your health information under HIPAA and applicable California law.
- To see and get a copy of your record.
- To ask us to correct something you believe is wrong.
- To ask for a list of certain disclosures we have made.
- To ask us to communicate with you a particular way or at a particular address.
- To ask us to restrict certain uses and disclosures.
- To be told if your unsecured health information is breached.
- To file a complaint with us or with the federal Office for Civil Rights without being penalised for it.
Our Notice of Privacy Practices explains these rights in full and tells you how to use them. Ask us for a copy at any time.
Children
This website is intended for adults. We do not knowingly collect information through it from children under 13. If you believe a child has sent us information, please tell us and we will remove it.
Other sites
This site may link to services we do not run. We are not responsible for their privacy practices. Please read their policies before you give them information.
Changes to this policy
We may update this policy. The date below tells you when it last changed. Material changes affecting your health information are also reflected in our Notice of Privacy Practices.
